1. Nature of Services
- MedGoPlus is a digital healthcare platform that connects patients with independent healthcare professionals, including doctors, nurses, health attendants, diagnostic centers, pharmacies, and hospitals (“Healthcare Providers”).
- We act only as a facilitator between users and Healthcare Providers.
- The healthcare services themselves are provided solely by the Healthcare Providers, who are independent professionals responsible for their advice, diagnosis, prescriptions, treatment, and procedures.
2. Eligibility
- You must be at least 18 years of age to use our Services.
- If you are using the Services on behalf of a minor, elderly person, or dependent, you confirm that you have the legal authority to act on their behalf.
3. User Responsibilities
- By using our Services, you agree to:
- Provide accurate, current, and complete information during registration and consultations.
- Use the Services only for lawful and personal healthcare-related purposes.
- Not misuse the Platform, attempt to hack, copy, or disrupt our Services.
- Comply with all applicable healthcare and data protection laws in India (and, if applicable, international jurisdictions).
4. Role & Liability of MedGoPlus
- Medinertia Technologies Ltd (MedGoPlus) is not a healthcare provider and does not practice medicine.
- We verify the education, registration, and certifications of Healthcare Providers through third-party checks, but we do not guarantee the quality, accuracy, or outcome of their medical services.
- We are not liable for:
- Misdiagnosis, mistreatment, negligence, or failure of treatment.
- Deaths, complications, or adverse outcomes resulting from consultations or procedures.
- Any disputes between patients and Healthcare Providers.
- All responsibility for diagnosis, treatment, and patient outcomes rests solely with the Healthcare Provider.
5. Appointments, Consultations & Payments
- Appointments made through MedGoPlus are subject to availability of Healthcare Providers.
- Payments for consultations, pharmacy orders, diagnostics, or hospital services may be facilitated through our Platform using secure payment gateways.
- Fees charged are set by Healthcare Providers or partner institutions. MedGoPlus may charge a convenience fee or commission for facilitating the service.
6. Health Assist & Hospital Referrals
- Through our Health Assist feature, we may guide patients towards suitable hospitals for certain treatments or surgeries, based on available information.
- MedGoPlus only acts as a facilitator for admission and coordination and does not provide medical or surgical services directly.
- The responsibility for treatment, surgery, post-operative care, and outcomes lies entirely with the hospital and its doctors.
7. Data Protection & Privacy
- By using our Services, you consent to the collection and use of your data in accordance with our Privacy Policy.
- Sensitive personal data, including health information, is handled in compliance with the Digital Personal Data Protection Act, 2023, and applicable healthcare regulations.
8. Limitations of Liability
- To the fullest extent permitted by law, Medinertia Technologies Ltd (MedGoPlus), its directors, employees, and partners shall not be liable for:
- Any indirect, incidental, or consequential damages.
- Loss of data, profits, or goodwill.
- Medical negligence or malpractice by Healthcare Providers.
- Our total liability, in any case, shall not exceed the amount paid by you to use the Services in the preceding three (3) months.
9. Intellectual Property
- All content, design, trademarks, and software on MedGoPlus are owned by or licensed to Medinertia Technologies Ltd.
- Users may not copy, modify, distribute, or reverse engineer any part of our Platform without written consent.
10. Termination
- We may suspend or terminate your account at any time if you violate these Terms, misuse the Platform, or engage in fraudulent activities.
- You may discontinue use of the Services at any time by uninstalling the app or deleting your account.
11. Governing Law & Dispute Resolution
- These Terms are governed by the laws of India.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of [Hyderabad/Vizag, Andhra Pradesh — choose your registered office location].
- Disputes may first be attempted to be resolved through arbitration, as per the Arbitration and Conciliation Act, 1996.
